1. Agreement to Terms

By accessing or using TextSpark (the "Service"), operated by Sweet Zo's, Inc., you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms constitute a legally binding agreement between you and Sweet Zo's, Inc. regarding your use of the Service, including our iOS application and any related services.

2. Description of Service

TextSpark is an AI-powered conversation assistant that helps users generate responses for dating app conversations. The Service includes:

• Screenshot analysis using OCR technology
• AI-generated conversation responses
• Conversation summarization
• Multiple response styles and languages
• iOS Share Extension ("Zap")

3. User Accounts and Subscriptions

Account Responsibility

You are responsible for safeguarding your device and any account credentials. You agree to accept responsibility for all activities that occur under your account.

Subscription Plans

• Free Tier: Limited to 5 responses and 2 summaries per week
• Premium Tier: Unlimited responses and summaries, access to all features

Payment and Billing

• All purchases are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions through your App Store account settings
• No refunds will be provided for any unused portion of a subscription term

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws or regulations
• Harass, abuse, or harm another person
• Impersonate or misrepresent your affiliation with any person or entity
• Create or distribute spam, malware, or malicious content
• Attempt to gain unauthorized access to the Service or its systems
• Circumvent usage limits or security measures
• Use the Service for any illegal or unauthorized purpose
• Violate the terms of service of third-party platforms where you use generated content

5. Intellectual Property Rights

Our Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Sweet Zo's, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws.

Your Content

You retain ownership of any conversation screenshots or context you provide. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

Generated Content

AI-generated responses created by the Service are provided to you for your personal use. You are free to use these responses in your conversations, but you acknowledge that similar responses might be generated for other users.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Key points:

• We do not store conversation content after processing
• Screenshots are processed on-device using iOS Vision framework
• We only collect minimal data necessary for the Service to function

7. Third-Party Services

The Service uses third-party services including:

• OpenAI: For AI text generation
• RevenueCat: For subscription management
• Supabase: For backend infrastructure

Your use of the Service may be subject to the terms and policies of these third-party providers.

8. Disclaimers and Limitations

No Guarantee of Results

TextSpark provides AI-generated suggestions only. We do not guarantee:

• Success in dating or relationships
• Specific outcomes from using generated responses
• That generated content will be appropriate for all situations
• Continuous, uninterrupted, or error-free service

AI Limitations

You acknowledge that AI-generated content may sometimes be:

• Inaccurate or inappropriate
• Not suitable for your specific context
• Similar to content generated for other users

Always review and modify generated content as needed before using it.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWEET ZO'S, INC. AND TEXTSPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to defend, indemnify, and hold harmless Sweet Zo's, Inc., TextSpark, and their licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. Age Requirements

The Service is intended for users who are at least 17 years old. By using the Service, you represent and warrant that you meet this age requirement.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
